Conditions of participation for the Testo Promotion
The following conditions apply to the participation in the Testo Promotion ("Promotion").
Organizer
The organizer of the promo is Testo SE & Co. KGaA, Testo-Strasse 1, 79853 Lenzkirch, Germany (“Organizer”). The promo will be handled by Testo Pty Ltd, Unit 11, 114-118 Merrindale Drive, Croydon South VIC 3136, Australia, the agency contracted to do so by the organizer.
Promotional object
The object of the promotion is the granting of a Prezzee eGift Card (operated by Prezzee Pty Ltd) to the total value of $1000 (GST incl.) following an eligible purchase of a Testo food safety instrument from the Testo online shop only within the promotional period.
Eligibility for participation
Eligible for participation are natural persons resident in Australia. Employees of the organizer, affiliated companies (ie. distributors, re-sellers of products from Testo Pty Ltd) and other companies involved in the conception and implementation of the promotion, as well as their relatives, are excluded from participation.
Participation is possible from the age of 18 years.
Participant then needs to make an online purchase for the selected instrument(s) using the add to cart link on the site. If the participant does not have a Testo Online account setup, this needs to be completed, by simply registering here. The purchase must be finalised with full and accurate contact (name, company, address, email, phone) and payment details with a proof of purchase being the Testo Tax Invoice supplied by Testo after the purchase. Participants who have made a successful purchase for any combination of Testo food safety instruments within the period 31-October-2023 and midday 15-December-2023 will automatically be entered into the draw for the $1000 Prezzee eGift Card prize. Only one prize will be drawn.
Once the promotional period has ended and after the eligible participants been checked and confirmed and all steps verified, the participant will be included in the prize draw which will be completed on the 15-December 2023 and the winner notified by the registered email or telephone number within 7 working days. The Prezzee eGift Card will be sent via digital means to the winner directly to the registered email address.
Participants can enter multiple times in the promotion with multiple purchases. Participations with different or several address data as well as other manipulative measures lead to the immediate exclusion of the participant from the promotion.
In return for participation in the promotion, the participant agrees that the organizer may use his personal data for advertising purposes (only to share relevant knowledge and product recommendations in future Testo campaigns).
Give away
After a successful eligibility check, every participant will enter the draw and 1 person will be drawn to win the $1000 Prezzee eGift Card. The agency sends the Prezzee eGift Card to the participant via digital means using the digital platform operated by Prezzee. Testo will take every possible step to ensure the eGift Card is received as intended and will work with Prezzee together, however, Testo cannot take responsibility for the loss of the eGift Card or any difficulties during redeeming gifts thereafer. The participant needs to accept these conditions of participation. Registered participants who are entitled to participate will generally receive the Prezzee eGift Card shortly after confirmation of contact details. If contact canot be made within 10 days after the completion of the draw, the participant may be excluded from the promotion and a re-draw will take place on the 12 January 2024.
A cash payment is excluded. The right to the give away is not transferable.
Liability
The organizer is not liable for any damages which occur in the course of the implementation of the promo, unless the organizer or his/her agent has caused the damage through gross negligence or intention or has violated a contractual (cardinal) obligation. In the case of slight violation of cardinal obligations, the liability of the organizer is limited to predictable, contractually typical damages. Liability in the case of culpable damage to life, body or health due to malicious concealment of defects is unaffected. Liability according to the product liability legislation is unaffected. Testo will provide an eGift Card to the winner and will not take any responsibility for damages caused to life, body, health or property with the redeemed product or service, the responsibility lies with the winner individual.
Data protection
The data from the participants recorded in the framework of the promotion will be recorded, stored and used for the implementation of the promotion. These conditions for participation are subject to Australian law, excluding international private law and the UN Convention on Contracts for the International Sale of Goods.
