Conditions of participation for the Testo Promotion
The following conditions apply to the participation in the Testo Promotion ("Promotion").
Organizer
The organizer of the promo is Testo SE & Co. KGaA, Testo-Strasse 1, 79853 Lenzkirch, Germany (“Organizer”). The promo will be handled by Testo Pty Ltd, Unit 11, 114-118 Merrindale Drive, Croydon South VIC 3136, Australia, the agency contracted to do so by the organizer.
This promotion is approved under Permit number: T23/1716
Promotional objective
The objective of the promotion is to provide a chance for Testo's customers to WIN a prize from a total prize pool of $10,000, consisting of 8 prizes once customer has provided a proof of purchase of a Testo instrument, purchased from an Authorised Testo distributor or re-seller with the minimum value of $400 on a single invoice. The prizes are namely 1 - holiday voucher ($4000 value), 1 - JB HiFi or similar Gift Card ($3000 value), 1 - Fuel Gift Card ($2000 value), 5 - Prezzee eGift Cards (each card worth $200 - total $1000 value).
The purchase should be made between 30 October 2023 and midday 15-December 2023 and the draw will be done on the 15 December 2023 at 15:00 in the afternoon from the Testo’s Head office at 11, 114-118 Merrindale Drive, Croydon South Victoria 3136. The draw will be conducted by a Testo staff member with all entrants included in a hat (represented by a sequence number on when they entered) and drawn from the most valued prize to the least valued prize in sequence and give all eligible participants to have the chance for all the prizes.
Eligibility for participation
Eligible for participation are natural persons resident of Australia. Employees of the organizer, affiliated companies (ie. distributors, re-sellers of products from Testo Pty Ltd) and other companies involved in the conception and implementation of the promo, as well as their relatives, are excluded from participation. Participation is possible from the age of 18 years.
Participation in the promotion
In order to participate in the promo:
After the registration has been checked and confirmed and all steps verified, the participant will be included in the draw which will be completed on the 15 December 2023 and the winner notified in writing (via registered email) within 7 working days. The prizes will then be arranged within 14 days with the winning participant(s). Winners will be shown for at least 30 days on this website (ref: https://www.testo.com/en-AU/promotion/Prize-draw)
Each participant can enter multiple times, given they have reached the minimum spend and each spend will count to an entry. Multiple participations with different or several address data as well as other manipulative measures lead to the immediate exclusion of the participant from the promotion. Prizes cannot be redeemed for cash.
In return for participation in the promotion, the participant agrees that the organizer may use his personal data for advertising purposes (only to share relevant knowledge and product recommendations in future Testo campaigns).
Give away
After a successful eligibility check of a Testo instrument purchase with minimum Invoice value of $400 on a single Invoice, every participant will enter the draw and 1 person will be drawn to win one of the major prizes. Each participant will have a chance to win a single prize, not multiple prizes. The agency sends the selected prize (in the form of a voucher) via email to the nominated email address following verbal confirmation. Registered participants who are entitled to participate will receive the winning prize as listed under Promotional Overview above within 20 business days of successful verification of their registration.
Re-draw details
If registered contact details are incorrect, after Testo's numerous attempts, the participant may be excluded from the prize draw and a re-draw will take place on the 19-January 2024 at 15:00 in the afternoon at Testo’s Head Office located at 11, 114-118 Merrindale Drive, Croydon South, Victoria 3136. The winner of the re-draw will be notified by writing (via registered email address) within 7 days. Re-draw winners will be shown for at least 30 days on this website (ref: https://www.testo.com/en-AU/promotion/Prize-draw) for the reference of all participants.
Prizes cannot be redeemed for cash. The right to the prizes is not transferable.
Cancellation
If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Organizer, the Organizer may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
Liability
The organizer is not liable for any damages which occur in the course of the implementation of the promo, unless the organizer or his/her agent has caused the damage through gross negligence or intention or has violated a contractual (cardinal) obligation. In the case of slight violation of cardinal obligations, the liability of the organizer is limited to predictable, contractually typical damages. Liability in the case of culpable damage to life, body or health due to malicious concealment of defects is unaffected. Liability according to the product liability legislation is unaffected.
Data protection
The data from the participants recorded in the framework of the promotion will be recorded, stored and used for the implementation of the promotion. Other
These conditions for participation are subject to Australian law, excluding international private law and the UN Convention on Contracts for the International Sale of Goods.
